Win the Senate, Lose the Court: The GOP’s Lame-Duck F@#k-You
Alito left the door open. Republicans have walked through that door before.
A note from Lawrence
Sam Alito told CBS he’s thinking about retirement “every term,” and added that it’s hard to predict what any president might do with a replacement. A justice who swears he’s above politics just admitted he’s reading the polls like a bookie.
Here’s the math. If Democrats take the Senate on November 3, the new majority isn’t sworn in until January 3. If Alito retires in the eight weeks in between, a defeated Republican majority gets one last shot to lock in a seat for thirty years. Anyone who thinks they wouldn’t dare should remember Merrick Garland’s 293 days, and Amy Coney Barrett’s confirmation eight days before an election. Mark the lame duck on your calendar like a court date.
